Staff Analysis of the Legislation

This bill limits the circumstances under which a municipality or county legislative body may impose a criminal penalty for a violation of an ordinance. The bill prohibits a municipality from imposing a criminal penalty greater than an infraction for a violation relating to an individual's use of their residence unless: 
  • The violation is a nuisance.
  • The municipality has imposed a fine on the individual for a violation that involves the same residence on three previous occasions within 12 months. 
The bill clarifies that an ongoing violation constitutes a single violation.
